These Terms of Service govern access to and use of the services offered by Sommer Agency, including its websites, platforms, applications, and third-party integrations.

By accessing our services or using any application developed or operated by Sommer Agency, you confirm that you have read, understood, and agree to these Terms of Service.

1. About Sommer Agency

Sommer Agency (Sommer Publicidade e Eventos LTDA) is a company operating in digital marketing, branding, technology development, and campaign management on digital platforms. We are based in Brazil. This English site is intended for visitors and prospective clients in the United States.

Services may include:

  • Brand positioning and visual identity
  • Website and landing page design and development
  • Paid media planning and management
  • Tracking, measurement, and reporting
  • SEO and generative engine optimization

2. Use of the services

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Interfere with or disrupt the operation of our systems
  • Attempt to gain unauthorized access to any part of our services
  • Use our services to transmit unlawful, misleading, or infringing content
  • Reproduce or redistribute our materials without authorization

3. Third-party integrations

Our services may connect to platforms operated by third parties, including Google, Meta, and email or CRM providers. Those platforms have their own terms and privacy policies, and we do not control them. Your use of them is governed by their terms.

Where we operate an advertising account on your behalf, the account remains yours, with administrator access on your side.

4. Intellectual property

All materials produced by Sommer Agency in the course of a client engagement, including source files, vectors, and asset libraries, belong to the client upon full payment, as set out in the applicable engagement agreement.

Materials published on our own websites, including text, design, and code, remain the property of Sommer Agency.

5. Limitation of liability

Our services are provided on an "as is" basis. To the fullest extent permitted by applicable law, Sommer Agency is not liable for indirect, incidental, special, or consequential damages arising from the use of, or inability to use, our services.

Marketing results depend on factors outside our control, including your pricing, your scheduling capacity, and how your team handles inquiries. We do not guarantee any specific volume of leads, patients, or revenue.

6. Suspension or termination

We may suspend or terminate access to our services if these Terms are breached, or where required by law. Termination does not affect obligations already incurred by either party.

7. Changes to these terms

We may update these Terms. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the services after a change constitutes acceptance of the updated Terms.

8. Governing law

These Terms are governed by the laws of Brazil, where Sommer Agency is incorporated, without regard to conflict-of-law principles. Nothing in this section removes any right you may have under the mandatory law of your place of residence.
